Drawdown Derby
Terms of use
Effective October 19, 2026. Version 2026-10-19.
These Terms govern your access to Drawdown Derby, including its website, beta, game, accounts, virtual wagering, store, and related services. The operator is Autoliquidated LLC d/b/a Drawdown Derby, a Texas limited liability company ("Derby," "we," "us," or "our"). By accepting these Terms or using the service, you enter into this agreement with Derby. If you do not agree, do not use the service.
1. Eligibility and account security
You must be at least 18 years old, able to enter into a binding agreement, and permitted to use the service under the laws applicable to you. Do not access the service where prohibited or evade an access restriction. You confirm your age and agreement at sign-up; we record the confirmation, its date, and the Terms version. An age checkbox is a declaration by you, not independent identity verification.
One account is permitted per person. Provide accurate account information, keep your email current, and do not share, sell, transfer, or create accounts for others. Authentication is provided by Clerk using the sign-in methods offered on the site. Protect your credentials and recovery methods, and promptly report suspected unauthorized access to hello@drawdownderby.com. You are responsible for activity you authorize and for misuse caused by your breach of these obligations, subject to applicable law.
2. Beta service and game changes
The beta is a testing service. Features, balancing, prices for future purchases, race formats, performance, and availability can change. Bugs, outages, delayed actions, interrupted races, and progress corrections can occur. We may suspend features, repair records, or reset affected beta progress when reasonably necessary for testing, security, or fair operation. No particular season length, ranking, reward, or uninterrupted access is guaranteed.
We will describe a material reset through the site or account notices where practicable, including its effect on purchased entitlements. A reset or discontinuation does not waive any refund or other remedy required by law. These Terms do not authorize us to charge you again for an existing purchase without your authorization.
3. $Vibebonds and virtual items
$Vibebonds are virtual game currency. Purchased and earned $Vibebonds form one spendable balance and can be used for the Book, care, entries, and eligible store items. $Vibebonds, horses, kits, rewards, and other virtual items are limited, personal, revocable, non-transferable licenses to use features within Derby, subject to these Terms. They are not money, deposits, securities, investments, or an ownership interest in Derby.
There is no cash-out. You cannot redeem a balance, winnings, horse, or item for money or anything outside the game. Do not sell, exchange, gift, or transfer accounts or virtual assets through outside markets. An in-game auction or other transfer expressly provided by the game operates only under that feature's rules and does not permit outside sales. A lawful refund of a purchase is separate from cashing out game winnings.
An item's description controls its included benefits and duration. Cosmetics change appearance. An item or rider with a stated gameplay effect provides only that stated effect, subject to game conditions and balancing; no purchase guarantees a win. A permanent item license means no stated consumption or expiry during the supported service, not a promise that the service or an unchanged item will exist forever. We may correct erroneous grants and remove benefits obtained through fraud or abuse.
4. Races, the Book, and virtual wagering
The Book and casino-style presentation simulate wagering with $Vibebonds. All stakes, returns, prizes, and rewards remain inside the game. Do not treat them as a way to earn money or recover a real-money purchase. Racing and virtual wagering can lose the entire amount committed. Play only within limits you choose, and stop if play causes distress.
Review the race, selections, market, stake, combinations, and quoted return before submitting. A boxed ticket contains multiple combinations and its total cost includes each purchased line. Estimated pool returns can change; a fixed quote is binding only when the server accepts a ticket under that quote. The server's accepted ticket and transaction record control, subject to correction of a verified error. A button press, loading animation, preview, or interrupted connection alone is not proof of acceptance.
Entries and tickets must satisfy the displayed eligibility, balance, market, and closing rules. Once accepted, a ticket cannot be changed or cancelled unless the applicable feature expressly permits it. Settlement follows the official server result and the rules for that market, including eligible field size, scratches, voids, and refunds. Refunds of virtual stakes return virtual currency, not money. We may void or correct transactions affected by a material malfunction, duplicate processing, fraud, or an invalid event. We will not change an accepted result solely because a member won.
Check your history before retrying an uncertain transaction and report discrepancies with the race or receipt identifier. Replays, animations, commentary, and provisional displays are presentations of the game; the recorded official result governs settlement. Device speed, a missed animation, or a delayed display does not change that result.
5. Care, retirement, and inactivity
Care, training, breeding, eligibility, injury, retirement, and entry requirements follow the rules displayed in the game. Consumed items and completed actions are not reversible merely because their outcome was disappointing. Horses can retire or become ineligible under those rules.
An account with a zero $Vibebond balance and no sign-in for 30 consecutive days is subject to idle repossession. Derby may repossess its horses and farm and offer those horses through in-game auctions. Repossession is permanent, subject to correction of an error or rights required by law. Signing in or obtaining a positive balance before the idle period completes ends that period. Account deletion and game inactivity are separate processes.
6. Purchases, delivery, and refunds
The store identifies whether an offer costs $Vibebonds or money. The checkout or purchase confirmation states the price, currency, quantity, and included benefits. You must be authorized to use the payment method. Stripe processes cash purchases; Derby does not receive or store your full payment-card number. Taxes and any applicable charges are disclosed at checkout. A disabled or unavailable offer cannot be purchased.
A cash purchase grants the described virtual entitlement after payment confirmation. Returning from checkout does not by itself establish successful delivery. Keep your receipt and contact us about a duplicate charge, unauthorized payment, incorrect grant, or missing purchase. Do not repurchase solely to resolve a delayed grant. We may delay or reject an order for payment failure, suspected fraud, an account restriction, or an obvious listing error; a payment taken for an unfulfilled cancelled order will be refunded as required by law.
Purchases are final except for a verified error, an express offer, or a remedy required by applicable law. Spending, wagering, or losing purchased $Vibebonds, consuming an item, or using equipment does not create a right to reverse the purchase because you disliked the outcome. This policy does not exclude rights concerning unauthorized charges, defective or undelivered digital content, mandatory cancellation rights, or other non-waivable consumer protections.
Request help at hello@drawdownderby.com with your account email, receipt or order identifier, purchase date, and the issue. Do not send a full card number, security code, password, or sign-in code. An approved cash refund is handled through the payment provider to the original payment method where possible; its processing time depends on that provider. Refunded or reversed entitlements can be removed and the account balance reconciled.
7. Payment disputes and account restrictions
Please contact us promptly about an incorrect charge so we can investigate. You retain your lawful right to dispute a payment with your bank or payment provider; contacting us is not a condition on that right and does not extend their deadlines.
A refund or dispute may reverse the related grant and place the account or purchases on hold while the payment and any spent benefits are reconciled. Fraudulent purchases, dishonest disputes, or attempts to retain reversed benefits can result in suspension, permanent closure, and removal of affected items or balances. We consider evidence of genuine error or unauthorized access. You may ask for a review at hello@drawdownderby.com. Any action remains subject to mandatory legal rights.
8. Fair play and acceptable use
Do not cheat, manipulate results or markets, exploit bugs, duplicate rewards, collude to abuse the economy, or evade a sanction. Do not use unauthorized bots, scripts, scraping, or automation. An interface or integration expressly authorized by Derby must follow its stated permissions and limits. Do not bypass authentication, attack the service, interfere with other players, collect others' private information, or test payment or security vulnerabilities against live users.
Do not submit illegal, threatening, harassing, hateful, sexually explicit, infringing, or deceptive content. Do not impersonate a person or the operator, expose private information, solicit outside sales of virtual assets, or use the service for fraud. Display names, horse names, crew names, and submitted content are subject to moderation. We may rename, restrict, or remove violating content and reverse benefits gained through a violation.
Report bugs privately through the bug-reporting contact. A good-faith report is welcome; it is not permission to access another person's data, damage systems, or exploit an issue. Stop testing when you encounter private data and include only the minimum information needed to explain the problem. No bug bounty or payment is promised unless separately agreed.
9. Content, intellectual property, and feedback
Derby and its licensors retain rights in the service, software, artwork, music, names, and other content. Your access license permits normal personal use of the service and does not transfer those rights. Do not copy or redistribute protected assets or reverse engineer the service except as applicable law or an express license permits. Third-party and open-source components retain their own licenses; music attribution is available in the credits.
You retain any rights you hold in content you submit. You grant Derby a non-exclusive, worldwide, royalty-free license to host, reproduce, display, and adapt that content as reasonably necessary to operate, moderate, and present the game and its historical records. You confirm you have the necessary rights and permissions. Game names, race records, crew activity, and Hall of Fame entries can be visible to others as described in the Privacy Policy. Do not place confidential information in public-facing fields.
We may use voluntarily provided suggestions and bug reports to improve the service without an obligation to pay for them. This does not transfer ownership of your personal information or displace the Privacy Policy.
10. Suspension, closure, and appeals
We may restrict or terminate access when reasonably necessary to address a breach, fraud, payment reversal, security threat, compromised account, or legal obligation. For a correctable issue we ordinarily provide notice and a chance to respond where doing so would not compromise security, an investigation, or other users. Serious or repeated abuse can result in permanent closure.
You may request account closure or appeal a restriction at hello@drawdownderby.com. We may verify control of the account before acting. Closure ends access to the account and its virtual licenses, subject to mandatory remedies. Deletion of personal information follows the Privacy Policy and does not require removal of records lawfully retained for accounting, fraud prevention, disputes, or anonymized game history.
11. Disclaimers and limitation of liability
To the maximum extent permitted by law, the service is provided "as is" and "as available," without express or implied warranties, including merchantability, fitness for a particular purpose, non-infringement, or uninterrupted and error-free operation. We do not guarantee outcomes, continued availability, compatibility with every device, or preservation of every beta record. The service provides entertainment, not financial or investment advice.
To the extent permitted by law, Derby is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or lost profits, revenue, or data. Our aggregate liability arising from the service or these Terms is limited to the greater of the amount you paid Derby in the 12 months before the event giving rise to the claim or US $100. Nothing excludes liability for fraud, willful misconduct, or any liability, warranty, refund, or consumer right that cannot lawfully be excluded or limited.
To the extent permitted by law, you agree to indemnify Derby against third-party claims and reasonable costs arising from your unlawful conduct, infringement, or material breach of these Terms. This obligation does not cover claims caused by Derby's own unlawful conduct. We will provide notice and reasonable cooperation and will not agree to a settlement imposing an admission or non-monetary obligation on you without your consent.
12. Governing law and disputes
Texas law governs this agreement without its conflict-of-law rules, except where mandatory protections in your jurisdiction apply. Subject to those protections, disputes belong in the state or federal courts in Texas and you consent to their jurisdiction.
Before filing a claim, either party should give the other a written description of the dispute and requested resolution and allow 30 days for informal resolution. Send notices to hello@drawdownderby.com. This process does not prevent urgent relief, a complaint to a regulator, a lawful payment dispute, or a filing needed to preserve a legal deadline. It does not require arbitration or waive a right your local law preserves.
13. Changes, notices, and other terms
Changes to these Terms will carry a new effective date and version. We will give reasonable notice of material changes through the site or account email where practicable and obtain renewed agreement where required by law. Changes do not retroactively remove accrued rights. Continued use after a properly notified change takes effect constitutes acceptance to the extent allowed by law; stop using the service if you do not agree.
These Terms, the applicable purchase disclosures, and expressly incorporated feature rules form the agreement about the service. The Privacy Policy explains our handling of personal information. If a provision is unenforceable, the remainder continues in effect. A failure to enforce a provision once is not a waiver. You may not assign this agreement without our consent; we may assign it to a business successor subject to applicable law and your existing rights.
Neither party is responsible for a failure caused by events beyond its reasonable control, except for obligations or remedies that law requires. Provisions intended to continue after closure, including payment reconciliation, applicable licenses, liability, and disputes, survive. Electronic notices satisfy a writing requirement to the extent permitted by law. Questions, notices, and support requests go to hello@drawdownderby.com.
